India's Legal Framework for Autism
The Rights of Persons with Disabilities Act 2016 (RPWD Act) is the cornerstone of legal protection for autistic individuals in India. It was a transformative step: for the first time, Autism Spectrum Disorder was explicitly recognized as a benchmark disability in Schedule I of the Act.
Before 2016, autism families navigated a system that didn't officially recognize their children's disability. Today, every autistic child in India with a documented disability certificate is legally entitled to a comprehensive set of protections, benefits, and services.
Step 1: Get the Disability Certificate
Everything starts here. Without a Disability Certificate, you cannot access most benefits.
Where to apply: Any government hospital with a Medical Board. This includes district hospitals, medical college hospitals, and AIIMS.
What to bring: Diagnostic report (from psychiatrist or developmental pediatrician), identity proof, address proof, photographs.
The process: The Medical Board assesses your child and assigns a disability percentage. For autism, this typically ranges from 40–80% based on functional impact.
Cost: Free at government hospitals. Private hospitals may charge ₹500–2,000.
Timeline: 1–4 weeks typically. Medical Boards sit periodically — call ahead to schedule.
Step 2: Apply for UDID Card
The Unique Disability ID (UDID) card is the universal disability ID card issued by the Ministry of Social Justice and Empowerment.
Apply at: swavlambancard.gov.in (online) or at your district CMHO/DRDEO office.
Documents needed: Disability Certificate, Aadhaar card, photograph, address proof, birth certificate.
Benefits of UDID:
- Single-stop recognition across all government schemes
- Railway concession certificate embedded in card
- Portability across states (no need to apply again if you move)
