RTE Act and Special Needs Children
The Right to Education Act 2009 (amended 2013) guarantees free and compulsory education for all children 6–14 in India, including children with disabilities.
The key provisions for special needs children:
- Free education in a neighborhood school
- No screening or capitation fees
- 25% reservation in private schools for disadvantaged children (includes disability category)
- Schools must not expel a child for disability-related behavior
What Schools Must Provide
Under RTE and the Rights of Persons with Disabilities Act 2016 (RPWD), schools must provide:
- Reasonable accommodation: Modifications that allow the child to access education
- Barrier-free environment: Physical accessibility
- Special educator support: At least one qualified special educator per school
- Individualized Education Plan (IEP): Customized learning plan
- No discrimination: Cannot refuse admission, cannot segregate based on disability
3% Reservation
Central government educational institutions must reserve 3% of seats for persons with disabilities (RPWD Act 2016). State government institutes follow state-level rules which vary.
Disability Certificate Required
To access most education-related accommodations and reservations, a Disability Certificate from a government medical board is required. This is separate from the UDID card (though both are recommended).
What If Schools Refuse?
1. Document the refusal in writing (ask them to put it in writing)
2. File complaint with District Education Officer (DEO)
3. File complaint with State Commissioner for Persons with Disabilities
4. Contact the National Commission for Protection of Child Rights (NCPCR) — they have a dedicated complaint mechanism
